Abstract

The European Convention on Human Rights is the first international treaty and the first regional codification in this area. The Convention contains both basic human rights and freedoms as well as a monitoring mechanism by the European Court of Human Rights and the Committee of Ministers of the European Council. Although the Convention accepted certain duties, the states retained a great deal of freedom in legally regulating the conditions for the enjoyment of rights and freedoms, including significant powers regarding the introduction of restrictions in the general social interest, as well as the right to place reservations on certain provisions of the Convention and protocols in case of their inconsistency with by law, Despite this, the European Convention contributes to the standardization of human rights standards. It served as a model for the American Convention on Human Rights (1969) and the African Charter on Human and Peoples' Rights (1981).
