Abstract

In this article, the author deals with issues related to the interpretation and application of the provisions of the Stabilization and Association Agreement between the European Communities, their member states and Serbia on the prohibition of discrimination against Serbian citizens in the member states regarding working conditions, wages and dismissal. An analysis of two decisions of the Court of Justice on the interpretation of the same provisions contained in the European agreements with Poland and Slovakia was given. In the analyzed decisions, the Court of Justice gave these provisions of the European Agreements the same meaning as the corresponding provisions on the prohibition of discrimination from the EC Treaty. Thus, the citizens of the 'associated' countries are practically equalized in terms of working conditions, wages and dismissal with the citizens of the member states. This means that after the entry into force of the Stabilization and Association Agreement, Serbian citizens in this segment will have the same treatment enjoyed by citizens of member states based on the EC Treaty.
