CRIMINALITY CONTROL WITHIN THE BOUNDS OF EU LEGAL SYSTEM

Abstract

Essay treats the legal framework and basic strategic goal of criminality control system, within the bounds of EU legal system. As basic activities police cooperation, judicial cooperation in criminal matters and harmonization of criminal legislation are analyzed. Europol, European Judicial Network, Eurojust and OLAF represent basic institutional framework for police and judicial cooperation in criminal matters. Author also analyzes previous experiences and achievements of regulations harmonization in criminal matters, and points out common problems noticed in the area. Common positions, framework decisions, decisions, conventions and Joint Action Decisions are being evaluated as basic measures intended at realization of police and judicial cooperation in the area of criminality control in EU legal system. EU Millennium strategy for battling the criminality was also analyzed, with special attention paid to the project analysis of Corpus Juris financial interest protection plan, regarded by European legal public, with more or less criticism, as the foundation of European criminal law.
